1. Definitions

In these Terms and Conditions:

2. Acceptance of Terms

By using our Website or engaging our Services, you confirm that you have read and understood these Terms and Conditions and agree to be bound by them.

You must be at least 18 years of age and have the legal capacity to enter into an agreement in Malaysia to use our Services.

If you are enquiring or acting on behalf of another person, you represent that you have authority to do so.

3. Service Description

Damai Advocates provides legal services in the area of family law, including:

Our services are offered in Malaysia and are governed by Malaysian law. We do not advise on Syariah law matters; our services apply to civil family law proceedings.

4. Engagement and Commencement of Services

A formal engagement commences when both parties have signed an engagement letter confirming the scope of work and the agreed fees. Submitting an enquiry through our Website does not create a legal obligation on either party.

We reserve the right to decline to act for any client at our professional discretion, including in cases of conflict of interest.

5. Fees and Payment

Our fees are discussed openly at the initial consultation and confirmed in writing in the engagement letter before any chargeable work begins. Fees for each service start from:

Final fees depend on the scope and complexity of the matter. We will inform you of any anticipated increase in fees before additional work is undertaken.

Payment is accepted by bank transfer or cash in Malaysian Ringgit (RM). Invoices are payable within fourteen days of issue unless otherwise agreed in writing.

6. Client Responsibilities

To allow us to provide our Services effectively, you agree to:

We cannot be held responsible for delays or adverse outcomes resulting from inaccurate information or a failure to cooperate.

7. Confidentiality

We maintain strict professional confidentiality in relation to all client matters. Information shared with us in connection with a legal matter is protected by legal professional privilege. We will not disclose information about your matter without your consent, except where required by law or applicable professional rules.

We ask that you likewise treat as confidential any communications or documents received from us.

8. Intellectual Property

All content on our Website — including text, design, and structure — is the property of Damai Advocates and may not be reproduced without our permission.

Documents prepared by us in connection with your legal matter are provided for your personal use in that matter only and may not be shared or used for any other purpose without our written consent.

9. Disclaimers

Legal advice is provided based on the information available to us and the law as it stands at the time of advice. We cannot account for subsequent changes in legislation or case law.

We do not offer any assurance regarding the outcome of legal proceedings or negotiations. Family law matters involve multiple variables, including the positions and decisions of other parties and courts, which are beyond our control.

Information on our Website is provided for general informational purposes and does not constitute legal advice. Please contact us directly for advice relevant to your specific situation.

10. Limitation of Liability

To the extent permitted by Malaysian law, our liability to you in connection with the provision of Services shall be limited to the fees paid by you for the specific matter to which the claim relates.

We shall not be liable for indirect, consequential, or special damages arising out of the provision of our Services or use of our Website.

11. Termination

You may terminate the engagement at any time by notifying us in writing. You will remain responsible for fees incurred up to the date of termination.

We may terminate the engagement if you fail to comply with your obligations under the Agreement, fail to pay fees when due, or if continuing to act would put us in breach of our professional obligations. We will provide reasonable notice where circumstances allow.

12. Dispute Resolution

We hope that any concern you have about our Services can be addressed informally. Please contact us in the first instance at [email protected] and we will seek to resolve the matter promptly.

If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of Malaysia, and governed by the laws of Malaysia.

13. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising under these terms shall be subject to the jurisdiction of the courts of Malaysia.

14. Changes to These Terms

We may update these Terms and Conditions from time to time. The current version is always available on our Website with the effective date noted above. Continued engagement of our Services following any change constitutes acceptance of the revised terms.
